@Nelkins..Reason you might prefere the demise is mainly that as long as the product that "infringes" is in direct competition with your own, and thus each unit sold most likely reduces your own sales-figures by a comparable number... Royalty payments are minute by comparasion to keep the entire profit.

Isn't that how Microsoft made it's billions? Infringing on other people's patents. DEC had an OS for their MicroVax called 'Windows' years before Microsoft.
IE was actually created by a small ISP in IA. etc...
